GUITAR CENTER LESSONS TERMS AND CONDITIONS

AUTOMATIC RENEWAL DISCLOSURE

Guitar Center Lessons is a recurring subscription service. Your subscription renews every twenty-eight (28) days ("Billing Cycle") and your payment method will be charged the applicable tuition amount for each renewal period until you cancel. You may cancel at any time through your online account at https://www.guitarcenter.com/Services/Lessons/Account-Request, and cancellation is effective immediately.

Overview of Lessons Subscription

Enrollment in Guitar Center Lessons ("GC Lessons") provides access to weekly in-person or online instructional services. Lessons are delivered as a four-lesson package each Billing Cycle and renew automatically unless canceled. You may cancel at any time through your online account at https://www.guitarcenter.com/Services/Lessons/Account-Request, and cancellation is effective immediately.

PLEASE READ THESE GUITAR CENTER LESSONS TERMS AND CONDITIONS ("LESSONS TERMS AND CONDITIONS") CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHT AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS.

THESE LESSONS TERMS AND CONDITIONS INCORPORATE THE FOLLOWING OTHER GUITAR CENTER POLICIES:

THE GUITAR CENTER DISPUTE DISPUTE RESOLUTION POLICY, WHICH REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES RATHER THAN JURY TRIALS OR CLASS ACTIONS
THE GUITAR CENTER TERMS OF USE
THE GUITAR CENTER PRIVACY POLICY
THE GUITAR CENTER PURCHASE TERMS, WHICH APPLY IF YOUR MAKE A PURCHASE FROM GUITAR CENTER; AND
THE GUITAR CENTER RENTAL TERMS, WHICH APPLY IF YOU RENT EQUIPMENT FROM GUITAR CENTER.

Acknowledgment Email

After enrollment, Guitar Center will send an acknowledgment email containing:

Automatic renewal terms
Billing Cycle and charge frequency
Cancellation instructions
Contact information

This email will be sent from Guitar Center and will include "Subscription Terms" in the subject line.

TECHNOLOGY FEE. There is a one-time $30 non-refundable technology fee per student with this purchase, due at the time of initial purchase. In the event enrollment in GC Lessons is cancelled and not reinstated within ninety (90) days of the cancellation effective date, any reenrollment will incur another $30 non-refundable technology fee per student. All technology fees are per student, not per family. If more than one family member is enrolled, each member enrollment will incur the $30 non-refundable technology fee.

INDIVIDUAL LESSONS. The recurring tuition fee provides students with individual weekly lessons per month. The tuition package fee is billed monthly in advance to secure a student’s lessons with instructors.

TUITION.

Each Billing Cycle includes four (4) individual lessons. Tuition amounts vary by location and are displayed during enrollment and checkout.

Your payment method on file will be charged in advance at the start of each Billing Cycle. The first recurring tuition charge occurs twenty-two (22) days after the date of your first scheduled lesson; subsequent charges occur every twenty-eight (28) days.

Guitar Center Lessons is a recurring subscription service. Tuition does not include curriculum or materials. Guitar Center may increase tuition with at least thirty (30) days’ advance written notice, including instructions on how to cancel before the change takes effect.

PAYMENT AUTHORIZATION.

By enrolling, you authorize Guitar Center to charge your payment method for each Billing Cycle for recurring tuition until you cancel. If the payment method is declined, Guitar Center may retry the charge for up to five (5) days. If unsuccessful, the subscription may be canceled.

In the event the payment method on file is declined, you understand that we will attempt to charge the card each day for five (5) days. If the payment method is declined on the 5th day, your account will be automatically canceled, and any scheduled lessons will be automatically canceled.

REGULAR ATTENDANCE. Regular attendance is critical to the success of lessons. Please plan to attend all lessons and arrive on time and prepared.

LESSONS RESCHEDULE POLICY.

Lessons may be rescheduled with at least 24 hours’ notice via your online account. Missed lessons without notice are forfeited. Unused lessons expire ninety (90) days after purchase. There will be no refunds or cash redemption available for expired lessons or forfeited lessons.

CANCELLATION OF ENROLLMENT.

You may cancel your subscription at any time online at:

Cancellation is effective immediately. No additional steps or communication are required. Prepaid tuition is non-refundable, and unused lessons expire thirty (30) days after cancellation unless prohibited by law.

Guitar Center may cancel enrollment for non-payment, repeated no-shows, inappropriate conduct, or inactivity exceeding 90 days.

POLICIES FOR COMMUNICATION.

Communications between GC Lessons staff and students must only be on site, at the facility, within GC Lessons systems, and directly related to instruction. Any other communication must be between the adult parent/guardian of any minor student and GC Lessons staff through GC Lessons operated phones, GC systems, and proper email addresses through GC Lessons. An adult parent or guardian must accompany any student under 12 years of age upon arrival and departure from every in-store lesson. Additionally, there are security cameras placed in the GC Lessons studios to capture the Lessons (video and audio), to further ensure the safety of both students and instructors and for training and quality assurance purposes. By completing the registration, you consent to the use of security cameras in the Lessons studios.

LESSONS PERFORMANCES.From time to time, GC Lessons may record, photograph or video a student during recitals and other public performances to be used on Guitar Center websites and any other medium. By completing the registration, you consent to such use as a student or legal guardian of a student.

MODIFICATION TO LESSONS TERMS AND CONDITIONS.

Changes to Subscription Terms

Guitar Center may modify these Lessons Terms and Conditions at any time. When we make changes to these Lessons Terms and Conditions, we will change the "Last Revised" date above. If a material change is made to these Lessons Terms and Conditions, we will post notice of that change on the first page of these Lessons Terms and Conditions. By completing registration, you agree to be bound by any such revisions, and you should periodically visit this page of the Site to examine the then-current Lessons Terms and Conditions by which you are bound. Material changes to subscription terms, including pricing, will be communicated 30 days before taking effect and will include instructions on how to cancel.

SEVERABILITY. If any provision of these Lessons Terms and Conditions is held by a court of competent jurisdiction to be unenforceable for any reason, the remaining provisions hereof shall be unaffected and remain in full force and effect.

INDEMNIFICATION. You agree to indemnify and hold harmless Guitar Center and its affiliated companies against all costs, expenses, damages, losses, and liabilities incurred or suffered by Guitar Center or our affiliated companies resulting from any violation by you of these Lessons Terms and Conditions.

GOVERNING LAW. These Terms of Use shall for all purposes be governed by and interpreted in accordance with federal law and the laws of the State of California. Any disputes between us will be settled by final and binding arbitration in Los Angeles, California. ANY ARBITRATION WILL BE ADMINISTERED BY NATIONAL ARBITRATION AND MEDIATION ("NAM") AND GOVERNED BY NAM’S APPLICABLE RULES (including the Comprehensive Dispute Resolution Rules and Procedures and/or the Mass Filing Supplemental Dispute Resolution Rules and Procedures, as applicable) as further described in the Guitar Center Dispute Resolution Policy.

HEADINGS. The section headings used herein are for convenience of reference only and do not form a part of these Lessons Terms and Conditions, and no construction or inference shall be derived therefrom.

ADDITIONAL TERMS AND CONDITIONS FOR LESSONS BUNDLE- For Select Stores ONLY

BILLING CYCLE COMMITTMENT. "GET 6 MONTHS OF GUITAR LESSONS FOR THE PRICE OF 5" means: you are committing to 6 "Billing Cycles" (defined above under "Tuition") at the price of 5 Billing Cycles. One Billing Cycle consists of four (4) lessons. Only new students at select participating locations are eligible for this Billing Cycle commitment discount.

You will be charged the full tuition fee amount foreach Billing Cycle after the first 6 Billing Cycles unless you cancel your subscription beforehand, as provided herein.

TECHNOLOGY FEE for Bundle Accounts ONLY. The Technology Fee is waived for new students participating in the Billing Cycle commitment described above.

EARLY TERMINATION FEE for Bundle Accounts ONLY. There is an early termination fee of $150.00, due at the time of cancellation, if you cancel prior to 6 Billing Cycles.
